The Supreme Court relying on its previous ruling in the case of Republic vrs High Court( Land Division) Exparte Hon Ken Agyapong.

In this case, Hon Ken Agyapong allegedly insulted the High Court judge on tv in respect of a land litigation.

The Supreme Court in quashing the orders of the High Court, which orders, were directed at Hon Ken Agyapong to show cause why he should not be punished for contempt of court, the Supreme Court reasoned that the High Court judge had only predetermined the outcome of the contempt matter and therefore violated the audi alteram partem rule.
