Assin Kyekyewere Circuit Court Acquits And Discharges Three Robbery Accused After Upholding Submission Of No Case To Answer.

The Assin Kyekyewere Circuit Court, presided over by Her Honour Dora G.A. Nkumsah Eshun, has acquitted and discharged three persons standing trial for attempted robbery after upholding a submission of no case to answer.

In her ruling, Her Honour Nkumsah Eshun held that the prosecution had failed to adduce sufficient evidence to establish a prima facie case against the accused persons.

She found that the evidence presented by the prosecution lacked probative value and was insufficient to sustain the charges or warrant the accused persons being called upon to open their defence.

Consequently, the court upheld the submission of no case to answer and acquitted and discharged the three accused.

The acquitted persons — Godwin Kwabena Mensah, 28, Kwadwo Frimpong, 20, and Kwabena Antwi, 30 — had been standing trial in connection with an armed robbery attack on a gold buyer and a farmer at Assin Ntow-Krom in the Assin North District of the Central Region on June 25, 2025.

The three were arrested during an intelligence-led operation by the Central North Regional Police Command, which suspected them to be members of a five-man gang that stormed the victims’ residence at about 1:00 a.m. on the day of the incident.

According to police investigations, the gang, armed with a three-barrelled pump-action gun and machetes, allegedly fired at least eight rounds at one of the victims, Kwabena Amos, inflicting severe injuries.

Amos sustained a machete wound and serious facial trauma after being struck with the butt of a gun, leaving his right eye badly damaged.

His younger brother, Richard Kumah, who was also targeted during the attack, escaped unhurt.

Investigators further disclosed that the suspects had earlier posed as job seekers in the community, a strategy believed to have been used to conduct surveillance ahead of the attack.

However, after the prosecution had closed its case, counsel for the accused persons filed a submission of no case to answer.

Upon evaluating the evidence before it, the court agreed with the defence that the prosecution had failed to establish a prima facie case and accordingly acquitted and discharged all three accused.

Meanwhile, the victims and their family have expressed dissatisfaction with the ruling and indicated their intention to petition the Attorney-General to review the case and take the necessary steps to revive the prosecution.

They maintained that they are unhappy with the court’s decision and are seeking a reconsideration of the matter in the interest of justice.
